Resolving Family Disputes Respectfully

What Is a Participation Agreement?

The success of Collaborative separation and divorce is built on the contract you and your partner sign with the professionals on your Collaborative Team. These "Participation Agreements" are a unique and critical feature of Collaborative Divorce.

You and your spouse each sign a Participation Agreement with your Collaborative Family Lawyers and any other divorce professionals you work with. This contract maps out your path through the Collaborative Process and formalizes your commitment to Collaborative values and principles.

When you sign a Participation Agreement, you are committing to:

  • Stay out of court
  • Communicate openly and with respect
  • Disclose all relevant information promptly
  • Keep negotiations confidential
  • Hire new lawyers and start over if you do decide to go to court
  • Not use any disclosed information against each other if you go to court
